Criminal liability for grave oral defamation and slander by deed committed by a Municipal Councilor against a Vice Mayor
Summary
Municipal Councilor Noel Villanueva was charged with grave oral defamation and slander by deed against Vice Mayor Yolanda Castro after making defamatory remarks and a 'dirty finger' gesture at the municipal building. The incident arose from Castro's refusal to approve Villanueva's leave monetization application. Lower courts convicted Villanueva of the grave offenses and awarded substantial damages. However, the Supreme Court modified the convictions to slight oral defamation and simple slander by deed, recognizing that Castro's unjustified refusal constituted provocation. The Court reduced penalties to P200.00 fines and deleted all damage awards, emphasizing that both public officials failed to maintain proper decorum and should bear their own losses. The case demonstrates that even provoked defamatory acts by public officials carry criminal liability, though provocation may mitigate the severity of the offense.

Legal facts
On September 12, 1994, at the Municipal Building of Concepcion, Tarlac, Municipal Councilor Noel Villanueva uttered defamatory words against Vice Mayor Yolanda Castro, calling her corrupt and dishonest in Kapampangan dialect, and made a 'dirty finger' gesture. The incident occurred after Castro refused to approve Villanueva's application for monetization of accrued leave credits. Both were public officials from opposing political camps. The confrontation took place in the presence of 20-30 people at the municipal hall.
Judgement and reasoning
2nd Municipal Circuit Trial Court (MCTC) of Capas-Bamban-Concepcion: Found petitioner guilty beyond reasonable doubt of Grave Oral Defamation and Serious Slander by Deed. Sentenced to imprisonment of four months and one day to one year in each case (to be served simultaneously) and ordered to pay P50,000.00 moral damages, P30,000.00 attorney's fees, and P1,000.00 appearance fee.
Court of Appeals (CA): Affirmed the RTC decision but deleted the award of exemplary damages, finding that petitioner was himself a victim of complainant's indiscretion for refusing without reason to approve his leave monetization application.
Regional Trial Court (RTC) of Tarlac: Affirmed the conviction but modified the penalty to indeterminate imprisonment from three months minimum to two years and two months maximum in each case (to be served successively). Increased moral damages to P100,000.00, added P50,000.00 exemplary damages, maintained attorney's fees of P30,000.00 and P1,000.00 per hearing.
Supreme Court (SC): Modified the convictions to slight oral defamation and simple slander by deed due to provocation by complainant. Reduced penalties to P200.00 fine each with subsidiary imprisonment. Deleted all damage awards, finding both parties contributed to the incident and should bear their own losses.
