Summary
Anthony Kerr Reyes was convicted of murdering Norman Cabuco on May 29, 2004, at Kanlord Bar in Malaybalay City. Eyewitness Ale Macatana testified that Reyes approached Cabuco while concealing a weapon behind his back, then suddenly stabbed him in the neck and punched him before leaving. Cabuco died from the stab wound. The Regional Trial Court found Reyes guilty of murder qualified by treachery and sentenced him to reclusion perpetua with damages. The Court of Appeals affirmed the conviction, and the Supreme Court likewise affirmed with modifications to the damages awarded. The Court rejected Reyes' denial and alibi defense, finding the eyewitness testimony credible and consistent. The killing was qualified by treachery due to its sudden and unexpected nature, giving the victim no opportunity to defend himself. The Supreme Court modified the damages to include temperate and exemplary damages with interest.
