Summary

Jeffrey Miguel was arrested by Bantay Bayan operatives while urinating in public and charged with illegal possession of 1.10 grams of marijuana under RA 9165. The RTC and CA convicted him, finding the search incident to a valid arrest lawful. However, the Supreme Court reversed, holding that Bantay Bayan operatives, as state actors, must comply with constitutional protections. The Court found no valid warrantless arrest occurred - Miguel was merely urinating, not committing a crime in their presence. The resulting search was illegal, rendering the seized marijuana inadmissible under the exclusionary rule. Since the drugs were the corpus delicti of the offense, Miguel was acquitted.
