Summary

This case involved a property ownership dispute where Nicolasa Macam, as executrix of Leonarda Macam's estate, sought to recover a house from Juana Gatmaitan. In 1929, Leonarda and Juana jointly purchased the house, though Leonarda provided the full payment. In 1932, they executed a mutual agreement (Exhibit C) declaring their respective property ownership and agreeing that whoever died first would transfer their property to the survivor. When Leonarda died first, Juana claimed house ownership. The plaintiff argued this was an invalid donation mortis causa lacking proper will formalities. The Supreme Court affirmed the lower court's decision, ruling that Exhibit C constituted a valid reciprocal contract under Article 1790 of the Civil Code, not a donation.
