Summary
This case involved a dispute between creditor Macondray & Co. and Attorney Zosimo Rivas over preference rights to costs awarded in favor of the latter's client, defendant Macario Jose. After winning a monetary judgment against Jose, Macondray was later ordered to pay P105 in costs when the Supreme Court reversed an execution order in a related case. When Rivas claimed attorney's lien preference over these costs against Macondray's right to set-off the costs against the unpaid judgment balance, the trial court initially favored the attorney. However, the Supreme Court reversed, holding that: (1) the preference question was res judicata from an earlier resolution, and (2) even without res judicata, the creditor's judgment preceded the attorney's lien under Article 1924 of the Civil Code. The decision clarified that attorney's liens under Section 37 of the Code of Civil Procedure take effect only after proper notice and entry in court records.
