Summary

This 1939 Supreme Court case involved a commodatum (gratuitous loan) dispute over furniture between landlord Margarita Quintos and tenant Beck. Under their lease agreement, Quintos lent furniture to Beck with the condition that he return it upon demand. When Quintos sold the property and demanded the furniture's return, Beck only partially complied, retaining gas heaters and electric lamps while depositing the rest with the Sheriff. The Court of First Instance ordered partial return with shared expenses. The Supreme Court reversed, ruling that under Civil Code Articles 1740-1741 governing commodatum, Beck was obligated to return all furniture to Quintos' residence upon demand. The Court found Beck breached the contract by retaining items and merely placing others at plaintiff's disposal rather than properly delivering them. The judgment ordered complete return of all furniture to plaintiff's residence, with defendant bearing all associated expenses and litigation costs.
