Josefa Labot v. Eduviges Librada

Summary

This case involves a property ownership dispute over a house and lot originally acquired by Maximino Librada and his second wife Nicasia Cervantes. After Maximino conveyed his half-interest to Nicasia in 1914, she sold the entire property to Josefa Labot and Potenciano Miranda in 1922. Eduviges Librada, Maximino's daughter from his first marriage, sued for recovery in 1936. The Court of Appeals ruled the 1914 conveyance was an invalid donation under Article 1334 of the Civil Code and awarded Eduviges one-twelfth of the property. However, the Supreme Court reversed, finding that the petitioners had acquired valid title through acquisitive prescription under Section 41 of the Civil Code Procedure, having possessed the property continuously and in good faith for over ten years since 1922, despite the vendor living with them until her death.
