Summary

This case involved a property ownership dispute arising from a sale with right to repurchase (pacto de retracto). Luisa Rafols sold urban property in Cebu to Koch & Brunner in 1889 with right to repurchase until 1897. After Luisa's death in 1894, her estate's testamentary executors, through family council authorization, conducted public auctions to sell the repurchase right. Agustina Rafols acquired the property through her husband's successful bid at the third auction in 1895, paying 6,432 pesos and settling 4,640 pesos with Koch & Brunner. When the repurchase deadline passed in 1897 without redemption, ownership consolidated in Agustina's favor.
