Teodoro R. Pulido v. The Hon. Manuel M. Lazaro

Summary

Teodoro Pulido challenged the administrative decision transferring his gasoline station dealership authorization to Virgilio Rosal. Originally holding a Shell sub-lease and BEU certificate, Pulido had authorized and later sold his rights to Rosal, then attempted to revoke the authorization. When he sued for unlawful detainer, the city court dismissed his complaint and affirmed the sale. Shell subsequently applied to BEU to officially replace Pulido with Rosal, which was granted. Despite winning on appeal to the Minister of Energy, the Office of the President reversed this decision. The Supreme Court ultimately dismissed Pulido's petition, holding that his original contract had expired, he had validly sold his rights to Rosal, and the binding city court judgment could not be challenged. The Court also rejected his due process claims, noting he had adequate opportunities to be heard throughout the administrative proceedings.
