Summary

The Supreme Court reversed lower court decisions and declared void ab initio a Deed of Extrajudicial Partition that included property belonging exclusively to Manuel Bautista in the supposed estate partition of his deceased first wife Juliana Nojadera. The Court held that extrajudicial partition under Rule 74 applies only to property belonging to the decedent's estate, not to property owned exclusively by the surviving spouse. The partition violated due process, resulted in preterition of compulsory heir Evangeline Bautista, and constituted prohibited partition of future inheritance under Article 1347 of the Civil Code. All subsequent transactions involving the property were declared null and void, and the original title was ordered restored to Manuel Bautista.
