Summary

This forcible entry case involved a land dispute between Gabriel Elane and Inocencio V. Chua over a 42,086-square meter parcel in Olongapo City. Chua held a Bureau of Forestry residence permit since 1961 and operated a warehouse and gasoline station on the property. In 1980, he discovered Elane constructing a building without permission. The lower courts initially favored Elane, but the Court of Appeals and Supreme Court reversed, finding Chua had priority of possession. The Supreme Court emphasized that in forcible entry cases, actual physical possession rather than legal right to possess is decisive. Applying Civil Code Article 538, the Court ruled that between two possessors, the one longer in possession prevails. Since Chua's possession dated from 1961 while Elane's could only be established from 1979, Chua was entitled to recover possession.
