The provision
In the execution of the agency, the agent shall act in accordance with the instructions of the principal. In default thereof, he shall do all that a good father of a family would do, as required by the nature of the business. (1719)

The agent's basic duty of conduct. He must follow the principal's instructions; where there are none covering the situation, he must do what a good father of a family would do, as the nature of the business requires. The standard is therefore a default, not a licence — it fills gaps in instructions rather than displacing them. Article 1884 makes the agent bound by his acceptance to carry the agency through and answerable for damages from non-performance, and Article 1909 makes him responsible for negligence as well as fraud, judged more or less strictly according to whether the agency was for compensation.
