What happens if a driver fails to help the accident victim?

Article 365 imposes the penalty next higher in degree on an offender who, by reckless or simple imprudence, fails to lend on the spot to the injured parties such help as may be in his hands to give. In short, a driver who flees or refuses to assist after an accident faces a heavier penalty than one who stops and helps.
