Answer

Under the Family Code, the family home is the dwelling house where the family resides and the land on which it is situated, constituted jointly by the husband and wife or by an unmarried head of a family (Article 152). Unlike under the old Civil Code, no judicial or extrajudicial constitution is required — the family home is deemed constituted from the time it is actually occupied as a family residence (Article 153).

Its beneficiaries are the spouses (or the unmarried head of the family) and their parents, ascendants, descendants, and brothers and sisters, whether the relationship is legitimate or illegitimate, who live in the family home and depend on the head of the family for legal support (Article 154). The Family Code sets a value, at the time of constitution, of three hundred thousand pesos in urban areas and two hundred thousand pesos in rural areas (Article 157).
