Summary
The Lustria siblings claimed ownership of half of Lot No. 6026 as heirs of Segundo Lustria, who died in 1931. The property was registered in 1953 solely under ADALIA Peñaflorida's name, subject to a two-year claim period for Segundo Lustria's heirs under Section 4, Rule 74. ADALIA sold the entire property to the Peñales sisters in 1970, who cancelled the encumbrance annotation in 1972. When the Lustrias sued for reconveyance in 1977, both lower courts ruled in their favor, finding an implied trust. The Supreme Court reversed, holding that the Lustrias had constructive notice of ADALIA's adverse claim from 1953, and their action filed in 1977 was barred by the 10-year prescriptive period. The property was declared to belong exclusively to the Peñales sisters.
